PROGRAM PARTICIPATION TERMS AND CONDITIONS

1. Agreement

1.1 This Program Terms and Conditions (the "Agreement") is a legally binding contract between you (the "Participant") and Kerrie Louise Norgate trading as The Global Institute for Women’s Embodiment ABN 97 954 990 579 (the "School", the "Facilitator") and applies to the purchase of the Program referred to below.

1.2 Please read this Agreement carefully and contact contact@womensembodiment.com if you would like to discuss any aspect of this Agreement.

1.3 You are deemed to have accepted the terms contained in this Agreement upon payment of your selected Program fees or deposit.


2. Term

2.1 This Agreement will begin upon payment of the Program fees, Program deposit, or entering the course platform.

2.2 It will apply for the duration of your access to the Program and completion of any payment plan extending beyond your initial purchase date.


3. Program

3.1 Program: Alchemy of Connection Self-Paced Program

3.2 Inclusions:

3.2.1 Lifetime access to the Alchemy of Connection Self-Paced Program, nine (9) modules, including pre-recorded teachings, embodiment and healing practices, and workbook.

3.2.2 The Program is a self-paced educational and coaching resource. Unless expressly stated otherwise at the time of purchase, it does not include live group coaching, private coaching, interactive Community access, or ongoing personalised coaching support.


4. Fees and Payment

4.1 Payment options for the Program are as detailed on the course sales page at time of purchase.

4.2 Alternative payment plans may also be available through direct conversation with Kerrie Louise Norgate.

4.3 All fees are in American Dollars and include GST (Australian Goods and Services Tax).

4.4 Payment is accepted by Credit or Debit Card.

4.5 Payment plans, if applicable, are as offered on the course sales page at time of purchase or by individual arrangement via email contact@womensembodiment.com.

4.6 Late Payments

4.6.1 You are responsible for ensuring that payments are made on time. Admin fees may apply for late or missed payments.

4.6.2 The School reserves the right to cease Program access until the due fees are paid in full.

4.6.3 If an account is beyond 14 days overdue, the School reserves the right to refer the account to third-party collections to collect your debt and all related legal fees and expenses.

4.6.4 This Agreement may be terminated at this time, and no further access to the Program will be provided.

4.6.5 Kerrie Louise Norgate also reserves the right to deny access to the School and future programs where appropriate.

4.7 Variation

4.7.1 Kerrie Louise Norgate reserves the right to vary fees at any time.

4.7.2 Changes in fees will not affect an existing purchase and will apply only to future purchases or new Program enrolments.


5. Refund Policy

5.1 No refunds are offered solely for withdrawal or change of mind, except where the Participant has rights or remedies under Australian Consumer Law.

5.2 Where circumstances warrant, the School may choose, at its discretion, to approve a change-of-mind refund before Program materials have been released or accessed. Any such discretionary refund may be reduced by reasonable transaction or administration costs actually incurred, to the extent permitted by law.

5.3 Where Program materials have been made available and the Participant subsequently chooses not to access, continue or complete the Program, the Participant remains liable for the Program fee, including any remaining payment-plan instalments, except where a remedy applies under Australian Consumer Law or otherwise by agreement with the School.

5.4 Nothing in this Refund Policy excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.


6. Refund Management and Consumer Rights

6.1 The Alchemy of Connection Self-Paced Program does not include the Stop Losing Yourself Guarantee or Personalised Progress Guarantee offered to eligible Participants of the Alchemy of Connection Interactive Community.

6.2 No particular personal, relational or other outcome is guaranteed from participation in the Self-Paced Program.

6.3 The Participant's rights under Australian Consumer Law continue to apply independently of the School's change-of-mind refund policy.

6.4 If the Participant believes there is a problem with the Program or that the Program has not been supplied in accordance with rights available under Australian Consumer Law, the Participant should contact the School at contact@womensembodiment.com with details of the issue and the remedy sought.

6.5 The School will assess any such request in accordance with this Agreement and its obligations under applicable law.

6.6 Where a discretionary refund is requested for circumstances that do not give rise to a legal entitlement to a refund or other remedy, the School may consider the request on a case-by-case basis but is not required to approve it.

6.7 Where the Participant purchases the Program using a payment plan and chooses to discontinue participation because of change of mind or other personal circumstances, the Participant remains liable for the outstanding balance unless otherwise agreed or unless the Participant has a right to cancel or obtain another remedy under applicable law.

6.8 Failure to make payments when due may constitute a breach of this Agreement. The School may seek lawful recovery of amounts properly owing under the Agreement.

6.9 Outstanding accounts may be referred to a third party for debt collection where appropriate and permitted by law.


7. Program Support and Communication

7.1 The Program is delivered through the Kajabi online training platform and is designed to be completed independently and at the Participant's own pace.

7.2 Purchase of the Self-Paced Program does not include ongoing individual coaching, live group coaching, Community coaching or personalised review of the Participant's relational circumstances unless such support is expressly included or purchased separately.

7.3 For questions relating to Program access, technical issues, accounts, payments or general Program administration, please email contact@womensembodiment.com.

7.4 Emails are generally responded to within 48 hours during business hours, Monday to Friday.

7.5 For confidential matters that specifically require direct communication with Kerrie Louise Norgate, she may be contacted at contact@kerrie-louise.com.


8. Participant Expectations

8.1 The Self-Paced Program is designed for independent learning and implementation.

8.2 To gain the greatest benefit from the Program, Participants are encouraged to:

8.2.1 Work through the core Program modules and relevant workbook exercises.

8.2.2 Engage with the teachings and practices at a pace appropriate to their circumstances and capacity.

8.2.3 Learn and practise new skills in real-life situations where appropriate.

8.2.4 Reflect honestly on their relational patterns, needs, boundaries and choices.

8.2.5 Take personal responsibility for deciding how, when and whether to implement the information and practices provided.

8.2.6 Seek appropriate professional or clinical support where an issue falls outside the scope of the Program.

8.3 Some teachings, practices and exercises may be identified as optional or bonus material. Participants are not required to complete every item of Program content.

8.4 The Program is not represented as a process that must be completed within a particular timeframe. Participants retain access in accordance with the lifetime-access inclusion described in Section 3.


9. Kajabi Program Portal

9.1 Access to the Program Portal is available only to Participants who have lawfully purchased or otherwise been granted access to the Program.

9.2 The Program Portal is provided for the Participant's personal access to Program teachings, practices, resources and workbook materials.

9.3 Program access is personal to the Participant and may not be shared with another person.

9.4 Participants must not permit another person to access Program materials using their login credentials.

9.5 Where any comments, discussion functions or other interactive features are made available within the Program Portal, Participants must communicate respectfully and must not publish abusive, threatening or unlawful material.


10. Technology Issues

10.1 If there are any problems with the website or if the host or network should go down due to circumstances beyond our control, The Global Institute for Women’s Embodiment shall not be held responsible to the extent permitted by law.

10.2 We will do our best to get the system back up as soon as possible when it is within our control.

10.3 To the extent permitted by law, The Global Institute for Women’s Embodiment shall not be liable to you or any other party because of viruses or malware that may infect your or any other party's electronic equipment.

10.4 You agree that you:

10.4.1 Will not use any robot, spider, or other device, process, or means to access the Program in an unauthorised manner.

10.4.2 Will not compromise or circumvent the security controls of the Program or otherwise gain unauthorised access.

10.4.3 Will not attempt to interfere with the proper working of the Program.


11. Program Portal

11.1 You will be required to register your details to create a password to access the Program content in the Program Portal.

11.2 It is your responsibility to ensure the details you provide are correct and current.


12. Password Security

12.1 You are solely responsible for the protection and confidentiality of any password issued to or subscribed for by you.

12.2 You will not share your password with any other person.

12.3 You will immediately notify us if your password is lost or becomes known to any other person.

12.4 You are responsible for access to and use of the Program via your password to the extent permitted by law.

12.5 The personal information you provide to the Program will be managed according to our Privacy Policy.


13. Confidentiality

13.1 Personal information shared with Kerrie Louise Norgate or The Global Institute for Women’s Embodiment through support correspondence or other direct communications will be managed in accordance with the School's Privacy Policy and applicable law.

13.2 Information may be disclosed where required or authorised by law.


14. Intellectual Property and Copyright

14.1 All material, including but not limited to videos, call recordings, resource downloads, and templates available in the Program and within any program created by Kerrie Louise Norgate, are the property of Kerrie Louise Norgate and The Global Institute for Women’s Embodiment and their affiliates or licensors.

14.2 Accordingly, they are protected by copyright, trademark, and other intellectual property laws.

14.3 As a Participant and Practitioner, you must ensure that you do not breach our intellectual property rights at any time.

14.4 You may not use any of the materials available in the Program or any teaching platform in a manner that infringes any of our rights or that has not been expressly authorised by us.

14.5 All material, including but not limited to videos, call recordings, resource downloads, and templates, is provided solely for your personal and non-commercial use unless you are a Practitioner who has completed the required Shakti Woman Facilitator Program.

14.6 Shakti Woman Practitioners may use the material for delivering the Program to their clients; use of materials is restricted to this purpose only.

14.7 Use of materials for any other commercial purpose is prohibited without the express written permission of Kerrie Louise Norgate.

14.8 You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium without the express permission of Kerrie Louise Norgate. You may request such permission by emailing contact@womensembodiment.com.


15. Disclaimer

15.1 General

15.1.1 You have engaged Kerrie Louise Norgate's services and purchased the Program at your own risk.

15.1.2 All content, resources and coaching materials are provided for personal use, education and information only.

15.1.3 Kerrie Louise Norgate does not offer any representations, warranties or guarantees, verbally or in writing, regarding any particular personal, relational, health, financial or other result from the Self-Paced Program.

15.1.4 No guarantee is made regarding the behaviour or choices of another person, the continuation, repair or ending of a particular relationship, finding or attracting a particular partner, or any health, medical, financial or other external outcome.

15.1.5 Individual results and experiences vary and depend on numerous factors, including but not limited to the Participant's circumstances, existing capacity, life context, engagement with the material and implementation.

15.2 Guest Speaker

15.2.1 From time to time, guest speakers may be engaged to present expert material during the course of the Program.

15.2.2 Opinions held and shared by guest speakers are not necessarily the opinions of Kerrie Louise Norgate, and she may not endorse the material or opinions presented.

15.2.3 You are responsible for how you manage any information or opinions provided by guest speakers, including how you may apply it to your personal or professional circumstances.

15.3 Medical Disclaimer

15.3.1 Kerrie Louise Norgate is a qualified trauma-informed somatic teacher, meditation teacher, Sacred Feminine Arts facilitator, and embodiment, sexuality and relationship coach.

15.3.2 Kerrie Louise Norgate is not a qualified doctor, psychologist, or counsellor.

15.3.3 Kerrie Louise Norgate does not claim to diagnose or heal conditions.

15.3.4 The information provided in the Program is not intended to, cannot, and should not be expected to be a substitute for advice and treatment from a qualified medical practitioner or mental-health professional.

15.3.5 Any changes you choose to make to your medication, health, or treatment protocols should be discussed with your primary healthcare provider.

15.3.6 The Program does not replace any treatment plans or protocols for diagnosed illnesses, mental-health conditions or medical conditions.

15.3.7 You are advised to consult an appropriately qualified healthcare professional before making health-related decisions during or as a result of participating in the Program.

15.4 Earnings Disclaimer

15.4.1 The Global Institute for Women’s Embodiment and Kerrie Louise Norgate cannot and do not make any guarantees about your ability to earn money from mentoring, advice, ideas, information or strategies provided in any Program.

15.4.2 You acknowledge that there is an inherent risk in any business enterprise or activity, and there is no guarantee that you will earn any money as a result of the purchase of any Program.

15.4.3 Nothing in this disclaimer will limit or exclude any liability that may not be limited or excluded by applicable law.


16. Limitation of Liability

16.1 Liability for the services provided by The Global Institute for Women’s Embodiment and Kerrie Louise Norgate is governed by the Australian Consumer Law, other applicable law and these Terms and Conditions.

16.2 Nothing in these Terms removes, restricts or modifies any statutory rights or remedies that cannot lawfully be excluded under Australian Consumer Law.

16.3 To the extent permitted by law, The Global Institute for Women’s Embodiment and Kerrie Louise Norgate exclude express or implied representations, conditions, guarantees, warranties and terms relating to the Program except those expressly set out in this Agreement or imposed by law.

16.4 To the extent permitted by law, The Global Institute for Women’s Embodiment and Kerrie Louise Norgate exclude liability for indirect, special or consequential loss arising from participation in or reliance upon the Program.

16.5 The Global Institute for Women’s Embodiment acknowledges that services supplied to consumers are subject to the consumer guarantees imposed by Australian Consumer Law, including applicable guarantees relating to due care and skill and fitness for a disclosed purpose.

16.6 Where liability or a consumer remedy cannot lawfully be excluded, restricted or modified, the Participant's rights and the School's obligations will be determined in accordance with Australian Consumer Law and other applicable law.


17. Dispute Resolution

17.1 You will contact Kerrie Louise Norgate or the School as soon as reasonably practicable with any concerns so that the parties have an opportunity to seek a prompt and effective resolution.

17.2 In the event of a dispute, the parties agree to the following procedure:

17.2.1 You should advise the School in writing of the nature of the dispute, the outcome you seek, and what actions you believe may settle the dispute.

17.2.2 The parties agree to engage in good-faith discussions, including meeting by video conference where reasonably appropriate, to seek to resolve the dispute by agreement and compromise.

17.2.3 If an agreement cannot be reached, either party may propose that the dispute be referred to mediation, including through an appropriate mediation service in New South Wales.

17.2.4 Both parties agree to participate in any mutually agreed mediation in good faith.

17.2.5 Nothing in this Section prevents either party from exercising a legal right, seeking urgent relief, contacting a regulator or consumer-protection body, or taking any step that cannot lawfully be restricted by this Agreement.

17.2.6 Communications made on a genuinely confidential basis during mediation or another confidential dispute-resolution process must remain confidential except where disclosure is authorised by the parties or required by law.

17.2.7 Nothing in this Agreement prevents a Participant from obtaining legal, financial, medical or other professional advice; making a complaint to a regulator or law-enforcement body; exercising rights under Australian Consumer Law; or making lawful and truthful statements about her experience.

17.2.8 Nothing in this Section authorises either party to make unlawful defamatory statements, disclose another person's confidential information without authority, or otherwise act unlawfully.


18. Governing Law

18.1 The Terms and Conditions of this Agreement are governed and construed under the laws of New South Wales.

18.2 Each party irrevocably and unconditionally submits to the jurisdiction of the courts of New South Wales, subject to any rights that cannot lawfully be excluded or restricted.


19. Acceptance

19.1 Thank you for reading this Agreement. By proceeding with your payment, you accept the Program Terms and Conditions contained in this Agreement.
